ENFORCEMENT PROCEDURE
If, after submitting a request for accessible information or a complaint, it has been dismissed, there is disagreement with the decision adopted, or the response does not meet the requirements set out in Article 12.5, the interested party may initiate a claim. A claim may also be initiated if twenty working days have elapsed without having received a response.

The claim may be submitted through the General Instance of the electronic headquarters of the Ministry of Economic Affairs and Digital Transformation, as well as through the other options provided for in Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. Claims will be received and processed by the General Subdirectorate for Service Inspection of the Ministry.
